Agreements, Waivers, Releases

Refund, Exceptions, and Make-up Agreement

Refunds:

When you book, you are booking a lesson or session at a specific time, date, and location with a specific instructor. This means another person is no longer able to book that time slot. Because of this, we do not offer refunds or makeups if it is 21 days or less before your lesson or first lesson of your session with a few exceptions.

Exceptions:

1) You will receive a 95% refund no matter the reason if someone books the same time slot your lessons would have taken place.

2) Make-up lessons will only be offered if your lesson is less than 2/3 of the allotted time (10 min for 15 min lesson, 20 min for 30 min lesson) for pool closures, inclement weather, or if the instructor is unable to attend. If you are unable to attend the makeup offered for Monday - Friday, Monday/Wednesday, or Tuesday/Thursday sessions, you will not receive any refund. If you are unable to attend any of the make-up times we offer you during the indoor season or if we are not able to offer you a make-up lesson, then you will receive a full refund.

3) If the student is sick, injured, has to quarantine due to COVID-19, or has a family emergency, you will receive a 50% refund (95% refund if someone takes your spot).

Make-ups (only offered for exceptions listed above):

Monday - Friday sessions will only have one make-up offered on the Saturday of the week of your session. If you are unable to attend the Saturday make-up day, you will not receive a refund.

Monday/Wednesday and Tuesday/Thursday sessions will only have two make-ups offered on the two Fridays of the weeks of your session. If you are unable to attend the Friday make-up day(s), you will not receive a refund.

Indoor lessons: We will do our best to make-up lessons during the indoor seasons at a time that works for you. If you are not able to attend any of the make-up times we offer you, then you will receive a full refund.

Diaper Agreement

We require swim diapers if your child is not 100% potty trained. An accident can shut down the pool and cancel students’ lessons for the whole day. We require a disposable swim diaper to be worn under a reusable swim diaper. Please respect other students and our host pools by ensuring your child has swim diapers that fit tightly and correctly. If your child does not have both diapers and/or the diapers do not fit tightly, we will cancel the lesson and you will not receive a refund.

Video/Photograph Release

I hereby authorize and grant All Knox Swim the irrevocable right and permission to use photographs, video recordings, and/or recorded testimonials of me, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation that I take, record, or share with All Knox Swim on All Knox Swim websites, social media platforms, and in advertisements, promotional flyers, or for any other similar purpose without compensation. I also hereby authorize All Knox Swim to take, record, or share photographs, video recordings, and/or recorded testimonials me, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation on All Knox Swim websites, social media platforms, and in advertisements, promotional flyers, or for any other similar purpose without compensation.

I understand and agree that such photographs and/or video recordings of me and my minor children may be placed on the Internet, such as but not limited to company websites and social media pages. I also understand and agree that I and/or my child may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings of me and my minor children. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of All Knox Swim. I authorize All Knox Swim to alter, copy, exhibit, publish, and distribute this media. I waive the right to inspect, review, or approve the final product of this media.

I have read and I understand this document. I understand and agree that it is binding on me, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation, our heirs, assigns and personal representatives. I acknowledge that I am eighteen (18) years old or more and that I am the parent or guardian of the child/children listed in my account.

I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name. This release is binding on me and my heirs, assigns and personal representatives.

Consent and Liability Waiver

I give consent for myself, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation to participate in activities with All Knox Swim. I understand that swimming is a HAZARDOUS activity with risks inherent to swimming lessons, such as bodily injury, paralysis, and death. I, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation assume all risk of loss, damage or injury arising out of participation in activities with All Knox Swim. On behalf of myself, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation, as well as our legal representatives and assignees, I hereby knowingly and intentionally hold harmless and release All Knox Swim, together with any sponsoring groups, clubs, directors, officers, agents, affiliates, employees, contractors, officials, sponsors, volunteers, as well as hosting/rented facilities and their respective owners, directors, officers, agents, affiliates, employees, contractors, officials, sponsors, and volunteers, from and against any and all claims, actions, suits and demands pertaining to or arising directly or indirectly out of any damage, loss, illness, injury, or death as a result of participation in these activities.

I understand that in these swim lessons, I will be doing a variety of aerobic exercises while learning how to swim. I understand that I will be in water of varying heights, in pools of varying shapes and sizes, and may be taught with people of varying ages.

The participants authorize any representative of All Knox Swim to have the participants treated in any medical emergency during their participation in the swim lesson program. Further the participant and/or parent/guardian agree to pay all costs associated with medical care and transportation for the participant.

I acknowledge that I am eighteen (18) years old or more and that I am the parent or guardian of the child/children listed in my account.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

While participating in swim lessons or programs held by All Knox Swim, consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings (when applicable) to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, All Knox Swim has put in place preventative measures to reduce the spread of COVID-19. However, All Knox Swim cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

Due to the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in All Knox Swim lessons or programs, or other face to face activities. By attending an All Knox Swim lesson or activity, you certify that you and/or your child/children do not fall into any of the following categories:

1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID- 19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

DUTY TO SELF-MONITOR:

Participants, parents of participants, and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact allknoxswim@gmail.com or 901-292-5359 if they experience symptoms of COVID-19 within 14 days after participating in an All Knox Swim lesson or activity.

ACKNOWLEDGMENT AND ASSUMPTION OF THE RISK. I acknowledge and understand the following:

1. I acknowledge that I, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation have willingly engaged in All Knox Swim lessons and/or activities. 

2. I know that participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.

3. I knowingly and freely allow myself, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation to participate regardless of such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of All Knox Swim, and it’s agents, instructors, employees, and any other related party.

4. On my, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation behalf, I hereby release, covenant not to sue, discharge, and hold harmless All Knox Swim, its employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating the activities relating to COVID-19.

5. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of All Knox Swim, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any All Knox Swim program.

I have read and I understand this document. I understand and agree that it is binding on me, my minor children listed in my account upon creation, and any minors that I add to my account after the initial account creation, our heirs, assigns and personal representatives. I acknowledge that I am eighteen (18) years old or more and that I am the parent or guardian of the child/children listed in my account.
